EPA's Proposed Regulation of Coal Ash Under Development

The US Environmental Protection Agency (EPA) is currently proposing to regulate the disposal and beneficial use of coal combustion residuals (commonly known as coal ash or CCR) from coal-fired electric generating stations. CCR are currently considered exempt wastes under an amendment to the Resource Conservation and Recovery Act (RCRA). The EPA is considering two possible approaches to regulation and will be holding public hearings through late summer.
